First, it seeks to outline the growth in outward-bound Canadian direct investments in the past 20 years, a trend fuelled largely by the financial services industry.  The second, related, objective is to demonstrate that Canada is now in fact a net direct investor abroad.  This relatively recent phenomenon has been driven in large part by financial services and natural resources firms, areas where Canada has traditionally enjoyed a competitive advantage either because of historical factors or because of natural endowments.  FDI trends reveal a growing vitality and maturity on the part of certain Canadian firms and the Canadian economy more generally, and broadly signal that Canada is becoming more active in the integrated global economy.</description>

	<title>The International Criminal Court: American Concerns About an International Prosecutor (New)</title>

	<description>This paper will provide a context for understanding the American objections to the jurisdiction of the ICC prosecutors, who have the power to initiate proceedings themselves – referred to as proprio motu authority.  To begin, the paper provides an overview of the development of international criminal law by tracing the historical path to the 1998 Rome Conference.  It then reviews the ICC Statute itself, particularly as it pertains to the office of the prosecutor and the proposed Pre-Trial Chamber process of judicial oversight.  A limited examination of the role of the prosecutor in national legal systems follows, with Canada receiving specific focus as a representative common law jurisdiction; the intention is that lessons relevant to the international context may be derived.  The next section reviews the main criticisms of the powers of the ICC prosecutor’s office, as well as other concerns about the Court, with an emphasis on the objections of the U.S. government.  A response to the American critique follows, with a discussion of the necessity of U.S. participation in the ICC.</description>

	<description>This paper provides an overview of recent federal spending on initiatives designed to promote investments in higher education and training, including direct and indirect financial support to individuals, and spending on infrastructure and capacity-building within Canada’s higher learning community.  The data presented here show that the vast majority of federal support that has been allocated to higher learning since the Canadian Opportunities Strategy (i.e., the February 1998 budget) has been directed at formal education, most notably universities.  In 2004-2005, the federal government spent more than $12 billion on PSE and training, roughly 60% more than in 1997-1998.  During this period, spending on PSE and training grew at an average annual rate of roughly 8.5%, approximately one percentage point above the rate of growth in federal budgetary program spending.</description>

	<title>Rail Shipper Protection Under the Canada Transportation Act (New)</title>

	<description>This document describes the provisions in the CTA that can bring some competitive pressure to bear on a monopolist railway, and some criticisms of those provisions.  This document also describes amendments to these and other provisions proposed in Bill C-58, an Act to amend the Canada Transportation Act (railway transportation) (introduced in the 39th Parliament on 30 May 2007) to address some of these criticisms.  Most notably, the bill proposes to:  remove the “substantial commercial harm” requirements for shippers that apply to certain competitive remedies (clause 1); allow shippers to jointly apply for final offer arbitration of a common matter (clause 7); and, give the Agency new authority to establish charges, or the associated terms and conditions, to shippers for the movement of traffic or incidental services (clause 3).</description>
