SUMMARY
This enactment amends the Pension Benefits Standards Act, 1985 to require the administrator of a pension plan to make available to the public an annual report in respect of any environmental, social or governance factors that the administrator took into account in the previous fiscal year in the selection, retention or liquidation of investments under the administrator’s responsibility or in the exercise of any rights relating to those investments.

SOMMAIRE
Le texte modifie la Loi de 1985 sur les normes de prestation de pension afin d’exiger de l’administrateur d’un régime de pension qu’il publie un rapport annuel sur les facteurs environnementaux, sociaux et de gouvernance dont il a tenu compte au cours de l’exercice précédent pour prendre des décisions relatives au choix des placements relevant de sa responsabilité ou de leur conservation ou liquidation, ou à l’exercice de droits liés à ces placements.

1. The Pension Benefits Standards Act, 1985 is amended by adding the following after section 13:
|
|
|
|

13.1 (1) The administrator of a pension plan shall, within 60 days after the end of each fiscal year, prepare a report stating whether the administrator took any environmental, social or governance factors into account during that fiscal year in making decisions respecting
|
|
|
|
(a) the selection, retention or liquidation of investments under the administrator’s responsibility; or
|
|
|
|
(b) the exercise of any rights relating to those investments.
|
|
|
|
13.1 (1) Dans les soixante jours suivant la fin de chaque exercice, l’administrateur d’un régime de pension établit un rapport indiquant si, au cours de l’exercice, il a tenu compte de facteurs environnementaux, sociaux et de gouvernance pour prendre toute décision relative :
|
|

a) soit au choix des placements relevant de sa responsabilité ou de leur conservation ou liquidation;
|
|
|
|
b) soit à l’exercice de droits liés aux placements visés.

|
|
|
|
(2) If the report states that the administrator did take environmental, social or governance factors into account in making any decisions referred to in subsection (1), the administrator shall include in the report a detailed explanation of how those factors affected each decision.
|
|
|
|
(2) Si le rapport indique que l’administrateur a tenu compte de facteurs environnementaux, sociaux et de gouvernance pour prendre toute décision mentionnée au paragraphe (1), celui-ci y précise la manière dont ces facteurs ont influencé chacune de ses décisions.
|
|
|
|
|
|
(3) The administrator shall provide a copy of the report without charge to any person who requests it.
|
|
|
|
(3) L’administrateur fournit gratuitement le rapport à toute personne qui en fait la demande.
