The Standing Joint Committee for the Scrutiny of Regulations met at 8:41 a.m., this day, in room 256-S, Centre Block, the Joint Chair, Mr. Gurmant Grewal, M.P., presiding.

Members of the committee present:

Representing the Senate: The Honourable Senators Michel Biron, James F. Kelleher, P.C., and Wilfred P. Moore (3).

Representing the House of Commons: John Cummins, Gurmant Grewal, Derek Lee, Paul Macklin, John McKay, Lynn Myers, and Tom Wappel (7).

In attendance: Joann Garbig, Joint Clerk of the Committee (House of Commons), and François-R. Bernier and Jacques Rousseau, Counsel to the Committee, Research Branch, Library of Parliament.

Also present: The official reporters of the Senate.

The committee proceeded to consider its permanent Order of Reference, section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which follows:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

The committee considered certain issues relating to correspondence received from Mr. Garry Breitkreuz, M.P.

It was agreed that the Joint Chairs send correspondence to Mr. Breitkreuz with respect to certain comments made by the committee.

On SOR/99-268 — Order Amending the Schedule to the Customs Tariff (Ferro-chromium and Certain Automotive Goods), it was agreed that the file be closed.

The committee considered SOR/2002-225 — Regulations Amending Certain Regulations Made Under the Fisheries Act (Miscellaneous Program) on which it was agreed that Counsel to the Committee review the status of the issue and Bill C-43, An Act to amend the Fisheries Act, and inform the committee of action taken.

On SOR/89-127 — Food and Drug Regulations, amendment, it was agreed that the Joint Chairs correspond with the Minister for International Trade with respect to certain comments made by the committee and that Counsel to the Committee also prepare a draft report to both Houses.

On SOR/92-631 — Vinyl Chloride Release Regulations, 1992, it was agreed that Counsel to the Committee review their status at a later date and inform the committee of the action taken.

On SOR/99-170 — Regulations Amending the United Nations Angola Regulations, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Department of the Environment with respect to certain comments made by the committee.

On SOR/96-48 — Exemption Regulations (Beef and Veal Imports), amendment, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Department of Foreign Affairs and International Trade with respect to certain comments made by the committee.

On SOR/88-230 — Frontier Lands Registration Regulations, and SOR/88-263 — Newfoundland Offshore Area Registration Regulations, it was agreed that Counsel to the Committee review their status at a later date and inform the committee of the action taken.

On SOR/95-571 — Royal Canadian Mounted Police Superannuation Regulations, amendment, it was agreed that Counsel to the Committee review their status at a later date and inform the committee of the action taken.

On SOR/97-501 — Privileges and Immunities of the Secretariat of the Convention on Biological Diversity Order, it was agreed that Counsel to the Committee review their status at a later date and inform the committee of the action taken.

On SOR/98-240 — Rules Amending the Bankruptcy and Insolvency Rules, it was agreed that Counsel to the Committee review their status at a later and inform the committee of the action taken.

On SOR/90-791 — Canada Oil and Gas Production and Conservation Regulations, SOR/92-676 — Nova Scotia Offshore Petroleum Drilling Regulations, SOR/95-188 — Nova Scotia Offshore Petroleum Drilling Regulations, amendment, SOR/93-23 — Newfoundland Offshore Petroleum Drilling Regulations, and SOR/95-101 — Newfoundland Offshore Petroleum Drilling Regulations, amendment, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Department of Natural Resources with respect to certain comments made by the committee.

On SOR/92-507 — Storage of PCB Material Regulations, it was agreed that Counsel to the Committee review their status at a later date and inform the committee of the action taken.

On SOR/92-620 — Corrections and Conditional Release Regulations, and SOR/96-108 — Corrections and Conditional Release Regulations, amendment, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Department of the Solicitor General with respect to certain comments made by the committee.

On SOR/2000-141 — Commissioner's Standing Orders (Dispute Resolution Process for Promotions and Job Requirements), it was agreed that Counsel to the committee review their status at a later date and inform the committee of the action taken.

On SOR/2001-520 — Canada Industrial Relations Board Regulations, 2001, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Canadian Industrial Relations Board with respect to certain comments made by the committee.
