Most notably, the bill proposes to: remove the “substantial commercial harm” requirements for shippers that apply to certain competitive remedies (clause 1); allow shippers to jointly apply for final offer arbitration of a common matter (clause 7); and, give the Agency new authority to establish charges, or the associated terms and conditions, to shippers for the movement of traffic or incidental services (clause 3).
